General Terms and Conditions
1. Applicability:
In these General Terms and Conditions the following definitions apply:
'IEDEREEN LOOPT BV': with registered offices at Noordzandstraat 85B, 8000 Brugge (België), registered under company number 0795.208.077.
Buyer': any natural person or legal entity that is or will be in a contractual relationship of any kind with IEDEREEN LOOPT BV.
Products': the object of one or more purchase agreements.
In addition to these General Terms and Conditions, specific terms and conditions may apply to certain services and/or products, if expressly indicated. Should there be any differences between these specific conditions and these General Terms and Conditions, the provisions of the specific conditions shall, in principle, prevail over the General Terms and Conditions, unless otherwise provided. One or more provisions of these General Terms and Conditions may only be deviated from if expressly agreed upon in writing. In that case, the other provisions of these Terms and Conditions shall remain in full force. General Terms and Conditions used by the Buyer do not apply. IEDEREEN LOOPT reserves the right to change and/or supplement the General Terms and Conditions at any time for future orders. By using the website or other electronic portal of IEDEREEN LOOPT and/or placing an order, the Buyer accepts these General Terms and Conditions as well as all other rights and obligations as stated on the Website. 2. Information and agreements:
IEDEREEN LOOPT takes the greatest care when placing information about the characteristics of the products online, including technical descriptions based on data from its partners and suppliers, as well as photographs illustrating the products, all this to the extent that the technical means allow and according to the best standards of the market. Certain characteristics of a product, such as colour, size, and others, may differ on delivery from the photographs shown on the website.
An agreement is concluded at the moment that an order confirmation is handed over to the Buyer or, in case the offer is made through the Website, is sent by e-mail to the e-mail address provided by the Buyer. A personalised offer has a validity of 2 weeks, unless a different period is stated in the offer. IEDEREEN LOOPT and its Buyer expressly agree that by using electronic forms of communication a valid agreement is formed. In particular, the absence of an ordinary, digital or electronic qualified signature does not detract from the binding force of the offer and its acceptance. The electronic files of IEDEREEN LOOPT apply, as far as the law permits, as a presumption of evidence. Information, images, oral announcements, etc. concerning all offers and the most important characteristics of the products provided by telephone or via e-mail are given as accurately as possible.
3. Pricing
All prices are quoted in euros and include any applicable VAT and other taxes. Special offers are only valid while stocks last. The Buyer shall owe the price that IEDEREEN LOOPT has stated in its confirmation in accordance with Article 2 of these Terms and Conditions. Obvious or obvious errors in the price quote, such as obvious inaccuracies, can also be corrected by IEDEREEN LOOPT after the conclusion of the agreement. Delivery costs shall be clearly communicated to the Buyer. With regard to certain payment methods, further conditions apply with regard to the delivery method and the possible costs. The Buyer will be clearly informed of this.
4. Payment
The sales prices indicated on the site include any taxes due, but do not include shipping costs. Any shipping costs are for the Buyer and will be displayed when you check out your digital shopping cart. We reserve the right to change the prices at any time, but we undertake to apply the rates indicated on the site at the time of your order. Online orders may be paid for by the usual valid and internationally accepted credit cards and electronic payment methods. Security measures via SSL are planned to ensure that your online payment is secure. If the payment cannot be handled immediately because a financial means of payment is chosen that cannot handle such immediate payment, IEDEREEN LOOPT a payment term of 10 days after the invoice date. If the customer does not pay the invoice within this specified period, the legal interest shall begin to accrue and shall be due without any express notice of default. Moreover, from the first reminder, an additional administrative cost of 10€ per file will apply. If payment is not received after 3 reminders, the invoice will be transferred to a collection agency or a legal office which will handle the procedure further. Complaints must be submitted within one week after the invoice date. The submission of a complaint shall not result in any suspension of payment. The Buyer shall also be liable for all (extra-)judicial costs of any kind incurred by IEDEREEN LOOPT as a result of the Buyer's non-compliance with its (payment) obligations.
If the Buyer chooses a payment method with a credit card, the conditions of the card issuer shall apply. IEDEREEN LOOPT is not a party in the relationship between the Buyer and the card issuer.
Subsequent payment with Billink: Payment must be made within the stipulated payment period to Billink B.V. All rights on account of the claim have been transferred by us to Billink, who will take care of the collection of the claim. Your data are tested and registered by or on behalf of Billink, these data may be used for the collection of claims and toesing of orders in the implementation of the acceptance policy of affiliated organisations. Billink reserves the right to refuse the Customer's request for payment on account. The payment term is a deadline. In the event of late payment, the Customer is therefore in default without notice of default being required and Billink is entitled to charge a contractual interest rate of 0.75% per month (whereby part of a month is regarded as a whole month) from the due date of the invoice. Billink is also entitled to charge extrajudicial collection costs to the Customer pursuant to the law. In case of Business Customers, Billink is also entitled to charge reminder and payment collection costs to the Customer, without prejudice to the right of Billink to charge the actual costs incurred to the Customer if these exceed the amount so calculated. These costs amount to at least 15% of the principal sum with a minimum of 40 euros for Consumers and 75 euros for Businesses. Billink is also entitled to assign the claim to a third party. That which is stipulated in the above with respect to Billink shall in that case also be transferred to the third party to whom the claim has been transferred.
5. Delivery
We may process your order depending on available stocks. In the event that a product is out of stock, this will be indicated on the website, or the product will be temporarily unavailable to order.
Orders will be delivered as soon as materially possible. All products are shipped (if in stock) within two working days after payment. IEDEREEN LOOPT does everything within its power to respect the mentioned delivery times. However, IEDEREEN LOOPT doesn't take any responsibility for deliveries that are too late or for an order that gets lost due to unforeseen circumstances or force majeure. These delivery times do not apply to orders that are paid for by bank transfer. For such orders the delivery period is two (2) working days after receipt of payment.
It is important that upon receipt of your products you check that they are in conformity with your order, and if this is not the case, please notify us within two (2) days. All notifications of a delivery that has not arrived on time must be made by e-mail to [email protected].
The stated delivery time is only indicative to the extent permitted by the Market Practices Act and therefore no rights can be derived from it. Deliveries are made to the address provided by the Buyer at the time the agreement is concluded. As soon as the products to be delivered have been delivered to the specified delivery address, the risk shall pass to the Buyer.
6. Identity theft and credit card fraud
In order to ensure the security of your online transactions, IEDEREEN LOOPT works together with recognised payment partners and credit card issuers. Online payments are carried out via a closed security system, which means that your bank details are always encrypted when they are sent over the internet. The loss or theft of your identity or credit card information is thus reduced to a minimum. IEDEREEN LOOPT believes they have taken all possible and relevant precautions and therefore acts as a normal, farsighted and careful online intermediary. Possible identity theft or financial theft cannot be held against IEDEREEN LOOPT.
7. Gebreken en Defects and complaintsklachtindiening
The Buyer is always obliged to carefully examine the products immediately upon receipt.
Complaints from the Buyer that relate to defects in the product or delivery, which are visible on the outside, must be reported in writing by the Buyer to IEDEREEN LOOPT within two (2) days after delivery. The Buyer is responsible for the costs of return shipments.
It can always happen that something does not go quite as planned. We recommend that you first make complaints known to us by emailing [email protected]. If this does not lead to a solution, it is possible to submit your dispute for mediation via WebwinkelKeur via https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil.
Since 15 February 2019 it is also possible for consumers in the EU to file complaints via the ODR platform of the European Commission. This ODR platform can be found at http://ec.europa.eu/odr . If your complaint is not yet being dealt with elsewhere then you are free to file your complaint via the platform of the European Union.
The Buyer is not entitled to return the products for which there are no substantiated complaints. If the above is not complied with and the goods are returned in error, all costs associated with returning the goods shall be borne by the Buyer. In that case, IEDEREEN LOOPT is free to store the products with third parties at the expense and risk of the Buyer for a period of 3 months, and/or to return these products to the Buyer at the implicit or explicit request and expense of the Buyer.
8. Exchange
The Market Practices Act (WMPC) stipulates that the Buyer can register the product for return within a period of 14 calendar days without any consequences in the sense of penalties or indication of reasons. This is called the right of renunciation. After this you have another 14 days to return your product. Are you using our returns portal? In that case you have 30 days to report the return. After this you have another 14 days to actually send it back.

If you do not use the return portal, the normal legal provisions apply. In this case, a return must be sent by Post or another carrier. The return of an order is at the expense and risk of the User, unless the product is not in conformity. Within the term of the warranty extension, the customer must return the product to EVERYONE and request a return document at [email protected].
In case of a valid and legally correct use of the abovementioned right of renunciation, IEDEREEN LOOPT shall within seven (7) working days take care of reimbursement of the amount paid by the purchaser to IEDEREEN LOOPT, by means of a payment method chosen by the purchaser but generally accepted internationally.
No refund is possible if the right of renunciation was unlawfully exercised. If the goods are sent back wrongly, all costs associated with the return shall be borne by the Buyer. In that case, IEDEREEN LOOPT is free to store the products at the expense and risk of the Buyer (with a third party) during 3 months, and/or to return these items to the Buyer at the implicit or explicit request and expense of the Buyer.

9. Force majeure
In the case of force majeure, IEDEREEN LOOPT shall not be obliged to fulfil its obligations towards the other party. IEDEREEN LOOPT is entitled to suspend its obligations for the duration of the force majeure.
Force majeure is understood to be any circumstance independent of its will that prevents the fulfilment of its obligations towards the other party in whole or in part.
10. Processing of personal data
The information you provide is necessary for the processing and completion of orders, and the preparation of invoices and guarantee contracts. If this information is missing, the order will inevitably be cancelled. Providing incorrect or false personal data is considered a breach of the present General Terms and Conditions. The personal data of the Buyer will only be processed in accordance with the applicable privacy statement, which can be consulted via the IEDEREEN LOOPT website.
11. Applicable law and competent court
All offers and agreements are exclusively governed by Belgian law. All disputes related to or arising from offers from IEDEREEN LOOPT, or agreements entered into with it, will be submitted to the court of the district of Kortrijk.
